Pool Paint Online – Terms of Service

0  Who we are

Monotek Pty Ltd T/A Pool Paint Online (ABN 54 679 277 840) is a business unit of Idiha Holdings Pty Ltd (“Pool Paint Online”, “we”, “our”, “us”).

1  Acceptance & scope

By accessing www.poolpaintonline.com.au (the “Site”) or purchasing goods or services (“Products”) you agree to be bound by:

  1. these Terms of Service (“Terms”);

  2. our Refund & Returns Policy;

  3. our Privacy Policy; and

  4. any additional terms we display with a Product (together, the “Agreement”).

If you do not accept every part of the Agreement, do not use the Site or place an order.

 

2  Australian Consumer Law (non-excludable rights)

Nothing in this Agreement excludes, restricts or modifies any right, remedy or guarantee you may have under the Competition and Consumer Act 2010 (Cth) Schedule 2 – Australian Consumer Law (ACL) or any other applicable law.

If the ACL applies, our liability is limited, at our option, to replacement, repair, resupply or refund, except where that liability cannot be so limited.

 

3  Eligibility & responsible use

  • You confirm you are at least 18 years old (or have parental consent) and legally capable of entering contracts.

  • You will not use the Site or Products for unlawful purposes (including unsafe disposal of chemical waste).

  • Do not transmit malware, scraping bots, or other harmful code.

We may refuse service or terminate accounts for breach, fraud, safety concerns or any other lawful reason.

 

4  Product information & safety

Pool paints, resins and solvents are regulated, hazardous chemical goods. Always read the Safety Data Sheet (SDS) and follow local regulations for storage, use and disposal. Colours displayed on-screen may differ from the finished product. Coverage estimates are guidelines only.

 

5  Pricing, GST & payment

All prices are shown in Australian dollars (AUD) and include GST unless stated otherwise. We may change prices at any time before you submit an order. We use Shopify Payments; your credit-card details are encrypted during transmission.

 

6  Orders, shipping & title

  • An order is accepted when we email you a tax invoice / order-confirmation.

  • Title passes when full payment clears; risk passes on delivery to your nominated address.

  • We may cancel an order (with a full refund) if stock is unavailable, pricing is incorrect or fraud is suspected.

Delivery timeframes are estimates; we are not liable for carrier delays outside our reasonable control.

 

7  Returns & refunds

Our Refund & Returns Policy (incorporated here by reference) explains when you may return Products, including exclusions for custom-tinted colours, special-order items and change-of-mind returns. Nothing in that policy limits your ACL rights.

 

8  Third-party tools & links

We provide certain third-party integrations (e.g. colour visualisers) “as is”. Your dealings with third-party sites are solely between you and that provider; we are not responsible for their conduct.

 

9  User content

If you post reviews, photos or other materials you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and adapt that content for marketing or operational purposes. You warrant you own or control all necessary rights.

 

10  Prohibited conduct

You must not:

a) breach any law, regulation or SDS instruction;

b) infringe intellectual-property rights;

c) harass, defame or discriminate;

d) introduce malicious code;

e) interfere with Site security or other users.

 

11  Disclaimers

Except as required by the ACL or other law:

  • the Site and Products are provided “as-is”;

  • we do not guarantee that the Site will be error-free or uninterrupted;

  • coverage rates, colour charts and technical data are guides only.

 

12  Liability cap

Where liability cannot be excluded but can be limited, our total aggregate liability to you (howsoever arising) is capped at the total amount paid by you for the Product giving rise to the claim.

This cap does not apply to liability for personal injury or death caused by our negligence, or for any liability that cannot be limited under the ACL.

 

13  Indemnity

You indemnify us, our directors, employees and agents against all loss arising from your breach of this Agreement or misuse of the Site or Products, except to the extent we caused or contributed to the loss.

 

14  Termination

We may suspend or terminate your access immediately if we reasonably believe you breached this Agreement. Clauses 2, 11-14 survive termination.

 

15  Governing law & jurisdiction

This Agreement is governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.

 

16  Changes

We may modify these Terms at any time by posting the revised version on the Site. Changes apply prospectively; your continued use after the effective date constitutes acceptance.
